By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Our store is hosted on Shopify Inc. and they provide us with the online e-commerce platform that allows us to sell our products and services to you.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse service to anyone for any reason at any time.

Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at

any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

SECTION 5 – PRODUCTS VARIATION

Sophisticards reserves the right to make, without notice any minor modifications in the specifications, designs, or materials that Sophisticards deem necessary or desirable.

All cards are handmade by Artisans not machines, the layout of the card, materials used and colour will differ from card to card.

Every card we make and offer on this website is bespoke and handmade to order, many of the products are naturally occurring and will always display colour variation along with variation in the layout in terms of position, size and number of items, however we will always do our best to remain as close as possible to the product chosen as seen on the website.

SMELL All flowers are preserved and do not have the perfumed flower scent, the odd petal may drop off in the box prior to delivery and every flower will exhibit natural colour variation.

NOT EDIBLE All products sold are not edible and should not be given to anyone under 16years and kept away from small children as they are delicate and small items of jewellery can be easily detached and could cause choking if swallowed.

 

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.

All products or services are available exclusively online through the web site. These products or services may have limited quantities and are all personalised and bespoke to order, they are not refundable, cannot be exchanged or cancelled except as indicated on our Returns and Cancellations Section 7 below

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

6.Discrepancies & Materials

Including, but not limited to:  Roses, Flowers, cardstock, embellishments, paper, and all products on our cards, Flowers are naturally occurring and many materials handmade,  Sophisticards is not responsible for any manufacturing or batch differences between individual components, either for items completed in the past for samples, between items of the same type, or pictured for promotional means. Discrepancies within acceptable margins are to be expected.

Promotional images used for any or all the items listed above have been presented as close to the finished and physical item(s) as possible.

These items may appear differently in person compared to on-screen and are also subject to discrepancies viewing on different devices at different levels of fidelity and brightness.

We also withhold the right to amend, change, remove or add materials at any given time without prior consultation, and as a result strongly recommend that clients check with us regarding materials at every order, to make sure wanted materials are available and still used. pe will not replace,  or refund any order where assumption have been made by the client regarding use of materials.

Sophisticards cannot be held responsible for any perceived colour discrepancies, any flower or material discrepancy that sits within acceptable margins on any of the basis' listed above, or incorrect ordering of materials where the client has ordered via the website.

All products contain mainly handmade and natural parts, including but not limited to the mounting of Flowers, cardstocks, adhering embellishments and assembly of cards. Given the handmade nature of this process, discrepancies between each item, samples and the item(s) received and what's seen on screen are to be expected.

There may be glue visible where certain materials meet, only visible at certain angles, margins may not be perfectly aligned, minor creasing and indents will on card and materials, this is normal when items are handmade and not machine assembled part of the manufacturing  process and is not classified as damaged or flawed.  Therefore Sophisticards will not refund or replace any cards where this process is visible.

We reserve the right to use our discretion when it comes to items that are out of stock of which our suppliers are having issues sourcing. In most cases we will provide a suitable alternate without prior consultation, and by agreeing to our Terms you accept our alternates.

Alternate products may differ from those shown, for instance the weight of cards stock, the shape of a crystal or handmade adornment.

We will not exchange or replace any items that have been ordered where suitable alternatives have been provided due to stock issues.

7.DELIVERY & CHARGES

Terms and Conditions of Trading By placing an order with Sophisticards, it is deemed that you agree to the following terms and conditions.

8.Delivery Delivery General Damage

To protect our cards in transit, all items are very carefully packaged and leave us in excellent condition. In the highly unlikely event that items are damaged in transit, you must report any damaged items to us within 24 hours of receiving your order. If you believe there to be damage to the order, it is imperative that you provide pictorial evidence immediately. If you are unable to provide proof of damage within 24 hours, then your claim will be nullified.

Any damage reported to us after this period will be classified as damaged after arrival (not due to courier) and will not be replaced. Please contact us with evidence of the damaged products (good quality images with irregularities clearly visible) prior to attempting to return/exchange them. We will review this evidence within 3 working days, and if approved we will provide you with a return label for you to use on the original packaging. Customers are responsible for return/exchange shipping costs, and we strongly advise you send using tracked delivery as we do not accept liability for products lost at this point. Once received, we will inspect in person and respond accordingly.

Sophisticards is unable to take responsibility for damage caused during delivery, although we do our best to ensure this doesn’t happen. Sophisticards cannot be held responsible for client approved errors and once items have been received any approved errors need to be reported. Please see section 6. Dependent upon size and quantities, stationery orders are sent by Royal Mail, or courier. Where applicable a tracking code will be provided. Once within the delivery network Sophisticards is not responsible for delivery timescales. Customers will need to contact the relevant shipping party with their tracking code for further information.

Please note: If the tracking app states that the package was delivered to the customer, Sophisticards will not be held responsible and will not offer any refunds or exchanges for any claims made by the customer.

Customer care - Contact us at WhatsApp or email info@sophisticards.com to assist you with any delivery queries, this will include providing tracking information if Royal Mail have not done so already.

Delivery addresses are taken from the Shipping Address provided at the time of checkout, and that is associated with your order. It is the client's responsibility to make sure this address is accurate AT THE TIME OF CHECKOUT.

Please note, that due to the delivery method you may be required to sign for your delivery. We cannot take responsibility for any lost items and if an incorrect address is found to be used, no refunds will be issued.

Your home or the recipient’s home should be put in the shipping address and that is the only shipping address we will accept.

Please note - Commercial addresses are NOT to be used for shipping addresses due to frequent loss of item.

Sophisticards are not responsible for any damage sustained to Cards that are are transported from the original recipient Sophisticards sent the card to.

 Elle Bee Design are not responsible for any damage sustained to invitations during transport to guests.

6.1 All delivery times quoted are estimates only and Sophisticards shall not be liable for any delay in delivery of the goods howsoever caused. This includes any consequential losses. Therefore, please allow ample time for any unforeseen delays. Sophisticards rely on third party delivery companies such as DPD and Royal Mail and as such Sophisticards cannot be held liable for any failings on their part.

6.2 Sophisticards may decline to deliver if Sophisticards believe that it would be unsafe, unlawful or unreasonably difficult to do so, or the premises (or access to them) are unsuitable for any Sophisticards

Company vehicles or those vehicles of agents employed by Sophisticards to carry out delivery.

6.3 Delivery of the goods shall be made by Sophisticards (or through an authorised agent) to the address of the buyer as stipulated on the order shipping address.

6.4 If the buyer fails to take delivery of the goods, then without limiting any other right or remedy available to the seller, Sophisticards may store the goods until actual delivery and charge the buyer for reasonable costs (including insurance) of storage.

6.6 Risk of damage to or loss of the goods shall pass to the buyer:

1. a) In the case of goods to be delivered at the buyers premises, at the time of delivery or, if the buyer wrongfully fails to take delivery of the goods, the time when Sophisticards has tendered delivery of the goods;

6.7 Notwithstanding delivery and the passing of risk in the goods, or any other provision of these terms, the property in the goods shall not pass to the buyer until Sophisticards has received payment in full of the price of the goods together with any charges in respect of carriage and insurance.

6.8 Until such time as the property in the goods passes to the buyer, Sophisticards may at any time require the buyer to deliver up the goods to the seller, and if the buyer fails to do so forthwith, enter on any premises of the buyer or any third party where the goods are stored and repossess the goods.

6.9 Goods sold on the website are sold in good faith and whilst every reasonable step is taken to ensure the correct picking and delivery of goods, errors do occur. Sophisticards cannot accept the cost and liability of any consequential losses as a result of the delivery of incorrect products, damaged or faulty goods or failure to deliver to a specific deadline.

6.10 Where the contract provides for the delivery of goods by instalments, each instalment shall be deemed to be the subject of a separate contract and non-delivery or delay in delivery of any one or more instalments shall not affect the balance of the contract or entitle the buyer to cancel the same.

6.12 If the buyer opts out of signed-for delivery, neither Sophisticards nor their carriers will be responsible for any loss.

Unfortunately, all of our products or services are personalised, may have limited quantities and made bespoke to order and cannot be returned, exchanged, refunded or cancelled under any circumstances unless they are faulty or damaged this must be reported within 24 hours of delivery to the shipping address. Faults do not include several petals or sepals falling of the Card in transit or at any period after as flowers are natural products.

Personalised items. We are not responsible in the event the personalisation requests you submit to us include spelling errors, typos, or any other kind of mistake. We will personalise items in accordance with the exact instructions you give to us. You will not be entitled to any refunds, returns or exchanges, unless the personalisation fault has been made by us or the seller.

10.1 Liability

10.1 A claim by the buyer which is based on any defect in the quality, quantity or condition of the goods shall be notified to Sophisticards Limited in writing, within 7 days of the delivery of the defect or failure. If delivery is not refused and the buyer does not notify Sophisticards accordingly, the buyer shall have no right to reject the goods and Sophisticards shall have no liability for such defect or failure, and the buyer shall be bound to pay the price as if the goods had been delivered in accordance with the contract.

10.2 Where the buyer does notify Sophisticards that there is a valid claim in respect of any of the goods, Sophisticards may replace or repair the goods or at its discretion refund to the buyer the price of the goods, in which case Sophisticards shall have no further liability to the buyer. The buyer will also allow Sophisticards a fair chance to inspect the goods for any damages or defects. Sophisticards shall not be liable to the buyer for any loss or damage arising out of any problem in relation to the goods and shall have no liability to pay any money to the buyer by way of compensation other than any refund made under these terms. This does not affect the buyer’s statutory rights as a consumer, nor is it intended to exclude Sophisticards liability to the buyer.

10.3 Sophisticards shall be under no liability in respect of any defect in the goods arising from any drawing or specification supplied by the buyer. Neither shall Sophisticards be liable for any errors in proofs approved by the buyer and Sophisticards is not responsible for checking the accuracy of information supplied by the buyer in electronic form.

10.3a Sophisticards shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, external force, damage caused by the buyer or any other party, or damage caused by the incorrect installation, use, modification, storage or repair of the goods.

 

10.3b The buyer is responsible for ensuring that any food, drug or other substance of a volatile nature is not likely to be affected by any material used in the manufacture, printing or handling of the goods.

Sophisticards are not liable if such food, drug or other substance has been adversely affected, and the buyer will indemnify Sophisticards and keep Sophisticards indemnified from and against all third-party claims that any food, drug or other substance has been adversely affected and caused third party loss, damage or expense.

CHILDREN -Sophisticards are not suitable for children, they are not edible and contain small items of jewellery that could cause choking if swallowed.

 

SECTION 11 -  ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

In no case shall Sophisticards, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

 

Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

 

(a) Sophisticards shall under no circumstances whatsoever be liable to the Customer, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with the Contract; and

 

(b) Sophisticards total liability to the Customer in respect of all other losses arising under or in connection with the Contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the price of the Goods.

Force Majeure

Neither party shall be liable for any failure or delay in performing its obligations under the Contract to the extent that such failure or delay is caused by a Force Majeure Event. A Force Majeure Event means any event beyond a party’s reasonable control, which by its nature could not have been foreseen, or, if it could have been foreseen, was unavoidable, including strikes, lock-outs or other industrial disputes (whether involving its own workforce or a third party’s), failure of energy sources or transport network, acts of God, war, terrorism, riot, civil commotion, interference by civil or military authorities, national or international calamity, armed conflict, malicious damage, breakdown of plant or machinery, nuclear, chemical or biological contamination, sonic boom, explosions, collapse of building structures, fires, floods, storms, earthquakes, loss at sea, epidemics or similar events, natural disasters or extreme adverse weather conditions, or default of Sophisticards or it's subcontractors.

SECTION 19 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless Sophisticards and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 20 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 22 - ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
